Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Bookflow mobile application and the website at getbookflow.co (together, the "Service"), operated by Bookflow ("Bookflow", "we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Acceptance of terms
You confirm that you are at least 13 years old, that the information you give us is accurate, and that you will keep it current. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms with you.
3. Your account
We use passwordless magic-link sign-in. You are responsible for keeping access to your email account secure, since anyone with access to it can sign in as you. Notify us at support@getbookflow.co if you suspect unauthorized access.
4. Subscriptions and billing
The Service offers a free tier and a paid "Pro" subscription. Subscriptions are sold and billed by Apple App Store or Google Play, not by Bookflow directly. Your subscription will:
- Charge your Apple ID or Google account at the price displayed at purchase.
- Renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- Be managed and cancelled in your Apple ID or Google account settings.
Any free trial converts to a paid subscription at the end of the trial unless you cancel before then.
5. Refunds
Because all purchases are processed by Apple or Google, refunds are handled by them under their respective policies. We do not issue refunds directly. To request a refund:
- Apple App Store — visit reportaproblem.apple.com and sign in with the Apple ID used for the purchase.
- Google Play — open the Play Store app or visit play.google.com → Subscriptions, find Bookflow, and follow the refund link.
6. AI-generated content
Bookflow uses third-party AI models (Anthropic Claude, ElevenLabs) to generate summaries, recommendations, conversational responses, and text-to-speech narration. AI output is generated automatically and may be inaccurate, incomplete, biased, or out of date. You should not rely on it as professional advice (legal, medical, financial, academic, or otherwise). You are responsible for evaluating AI output before acting on it.
We do not claim copyright in AI-generated text or audio produced for your account, and we do not use your interactions to train third-party models without your consent.
7. Your content
You retain ownership of the content you create in Bookflow — your library, highlights, notes, and tags ("Your Content"). You grant Bookflow a worldwide, non-exclusive, royalty-free license to store, process, transmit, and display Your Content solely to operate and improve the Service for you. We don't claim ownership and we don't sell Your Content.
8. Acceptable use
You agree not to:
- Use the Service for anything unlawful, deceptive, or harmful.
- Upload content you don't have the right to upload, or that infringes anyone's intellectual property.
- Attempt to reverse-engineer, decompile, or circumvent the Service's security or rate limits.
- Scrape, mass-download, or resell the Service or any data from it.
- Use the Service to send spam, malware, or unwanted communications.
- Interfere with other users' use of the Service.
We may suspend or terminate accounts that violate these rules.
9. Intellectual property
The Service, including its software, design, logos, and original content, is owned by Bookflow and protected by intellectual-property laws. Nothing in these Terms gives you any right to our trademarks or branding.
10. Third-party content
Book metadata (titles, authors, cover images, descriptions) shown in the Service may come from third-party sources, including publishers and open catalogs. We are not responsible for the accuracy of that information.
11. Copyright / DMCA
We respect intellectual-property rights. If you believe content available through the Service infringes your copyright, send a notice to support@getbookflow.co with:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing and where it is located in the Service.
- Your contact information (address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We will respond to valid notices. Repeat infringers' accounts will be terminated.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we handle it.
13. Termination
You can stop using the Service and delete your account at any time (see Privacy Policy § 8). We may suspend or terminate your access if you violate these Terms or for other lawful reasons. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKFLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKFLOW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 50, WHICHEVER IS GREATER.
16. Indemnification
You agree to defend, indemnify, and hold harmless Bookflow from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you in-app or by email. Continued use of the Service after a change means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the courts of Lagos, Nigeria, except where applicable consumer-protection law in your country of residence gives you the right to bring proceedings in your local courts.
19. Apple App Store additional terms
If you download Bookflow from the Apple App Store, the following additional terms apply and supersede anything inconsistent in the rest of these Terms:
- These Terms are between you and Bookflow, not with Apple. Apple is not responsible for the Service or its content.
- The license granted to you is a non-transferable license to use Bookflow on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
- Apple has no obligation to provide any maintenance or support for Bookflow.
- If Bookflow fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Bookflow.
- Bookflow, not Apple, is responsible for addressing claims relating to the Service, including product-liability claims, claims that the Service fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
- Bookflow, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Service.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
